For landlords, by landlords

Landlord Rescue Limited

Privacy Policy

We take your privacy seriously. This notice explains what personal information we collect, why and how we use it, who we share it with, how long we keep it, and the rights you have over it. We have written it in plain English, but it is a full privacy notice for the purposes of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

1. Who we are

Landlord Rescue Limited is a company registered in England and Wales. We provide property support, accountancy and tax services to landlords and property owners. We are an ACCA-accredited firm (ACCA Firm ID 6317144).

For the purposes of data protection law, Landlord Rescue Limited is the “controller” of the personal information you share with us. That means we are responsible for looking after it and for deciding how and why it is used.

The person responsible for data protection matters within Landlord Rescue Limited can be contacted using the details in section 15 below. We do not have a statutory requirement to appoint a Data Protection Officer, but we take our responsibilities under UK GDPR seriously and handle data protection queries promptly.

2. What information we collect

We only collect information that is necessary to respond to your enquiry and to provide our services. The personal information we may collect includes:

  • Contact details - your name, email address, telephone number and postal address.
  • Property details - information about the property or properties you are contacting us about, such as the address, tenure, condition and your ownership interest.
  • Financial and tax information - where relevant to the accountancy or tax services you are asking about, such as approximate values, rental figures, mortgage details and tax circumstances. We will only ask for what we need at the stage we need it.
  • Identity information - where required for anti-money laundering (AML) or other legal checks, we may ask for proof of your identity and address.
  • Correspondence - records of your calls, emails, messages and the conversations we have with you, so we can follow up properly and keep a clear record of what was discussed. Calls to our main number are answered by an AI assistant. Calls are recorded and transcribed so we can follow up properly.
  • Booking information - when you use our online calendar to book a conversation, the date, time and details you enter are collected to arrange that appointment.
  • Letter reference - if you arrive via a letter we have posted, we may record the reference on your letter so we know which campaign it relates to and can tailor our conversation.
  • Technical information - basic information about your visit to our website, such as your browser type and approximate location, collected automatically to help the site work and to keep it secure.

We do not knowingly collect special category personal data (such as information about your health, religion or ethnicity) through our website or forms. If such information is ever needed, we will only collect it with your explicit consent and explain why at the time.

We do not intentionally collect personal information from anyone under 18. If you believe a child has provided us with personal information, please contact us so we can delete it.

3. Where we get your information

If you have received a letter from us, you may not have given us your details directly. We find landlords and property owners using:

  • council HMO licence registers and other public registers
  • Companies House (for properties owned by a company, including director and owner details)
  • property data services such as Searchland
  • the open electoral register
  • publicly available information online, including search engines and social media profiles

We use this to find your name, a postal address for you, the property you own and any licence details. We only use it to write to you about leasing or buying your property. You can ask us to stop at any time (see Marketing below).

4. How and why we use your information

We use your personal information only for specific, clearly defined purposes. The table below sets out each purpose and the lawful basis we rely on under UK GDPR.

Understanding your property, circumstances and goals to discuss possible routes forwardLegitimate interests / contract once engaged
Providing the property, accountancy and tax services you ask us to provideContract (taking steps at your request before a contract, and performing it once agreed)

When we rely on our “legitimate interests”, we have weighed these against your rights and freedoms and are satisfied they are reasonable and expected. We do not use your personal information in ways that would have an unjustified effect on you.

We do not carry out solely automated decision-making or profiling that produces legal or similarly significant effects about you.

5. Marketing

We may write to you by post about our services, using the sources listed above, where we have a legitimate interest in contacting property owners about leasing or buying their property. Each letter tells you how to stop further letters.

We only send marketing emails or texts if you have asked for them, or if you are an existing client and we are writing about similar services.

To stop all marketing, use the “Please don’t write to me again” link on our website, call us and ask our assistant to take you off our list, reply to any message, or email us. We’ll stop straight away and keep a short note of your request so you’re not contacted again by mistake. We do not sell your personal information or share it for others’ marketing.

6. Who we share your information with

We do not share your personal information widely. We only share it where it is necessary, and we expect anyone we share it with to look after it to the same standard we do. The main categories of recipient are:

  • Service providers and processors - trusted third parties who help us run our business, such as the provider of our online booking calendar, customer relationship management and email tools, telephone and IT services. They act on our instructions as our processors, are bound by written agreements, and cannot use your information for their own purposes.
  • Professional advisers - such as our own legal, accountancy or compliance advisers, where we need their advice.
  • Other parties in a property transaction - where you ask us to progress a sale, lease or other arrangement, we may need to share relevant details with solicitors, surveyors, managing agents or lenders involved in that transaction. We will only share what is needed.
  • Partner property investors and operators - where we think one of our trusted partners is the right fit to lease or buy your property, we may share your name, contact details and property details with them so they can make you an offer. They become responsible for your information once they have it.
  • Legal and regulatory bodies - where we are required to by law, or where we need to report to our regulator (including ACCA) or to comply with anti-money laundering requirements.

We may also disclose information where required by law, court order, or to protect our legal rights or the rights, safety or security of others.

7. International data transfers

We are based in the UK and most of our processing takes place here. Some of the service providers we use (for example, providers of online booking or software tools) may process information outside the UK, including in countries such as the United States.

Where your personal information is transferred outside the UK, we only do so with appropriate safeguards in place. This may mean the country has been recognised by the UK government as providing an adequate level of protection, or that we rely on approved legal mechanisms such as the UK International Data Transfer Agreement or Standard Contractual Clauses, together with any further measures needed to protect your rights. A copy of the safeguards we rely on can be requested using the contact details in section 15.

8. How long we keep your information

We only keep your personal information for as long as we need it for the purposes described in this notice, and in line with legal and regulatory requirements. As a general guide:

  • Enquiries that do not become instructions - we keep your details for a reasonable period so we can respond to you and keep a record of the conversation, then delete or anonymise them (typically up to 24 months).
  • Client records - if you become a client, we keep your records for as long as required by law and by our professional obligations as an ACCA-accredited firm. For accountancy and tax records, this is generally at least six years after our work together ends or the relevant tax year ends, in line with HMRC requirements.
  • Anti-money laundering records - kept for five years from the end of the business relationship or the date of an occasional transaction, as required by the Money Laundering Regulations.
  • Marketing - we keep marketing consent records for as long as you remain subscribed, plus a short period afterwards to evidence your opt-out.

When information is no longer needed, we delete it securely or anonymise it so that it can no longer identify you.

9. Cookies and similar technologies

Our website uses a small number of cookies and similar technologies. These fall into two broad types:

  • Essential cookies - these are needed for the website to function (for example, remembering your booking details between steps). They cannot be switched off in our systems.
  • Analytics and preference cookies - these help us understand, in general terms, how visitors find and use the site so we can improve it. We only set these with your consent where consent is required.

You can control or delete cookies through your browser settings. Disabling some cookies may affect how parts of the website work. Our third-party booking and form widgets may also set their own cookies; please see those providers’ policies for details.

10. Your rights

Under UK data protection law, you have a number of rights over your personal information:

  • The right to be informed - to be told how we use your information (this notice is part of that).
  • The right of access - to ask for a copy of the personal information we hold about you (a “subject access request”).
  • The right to rectification - to ask us to correct information that is inaccurate or incomplete.
  • The right to erasure - to ask us to delete your information in certain circumstances.
  • The right to restrict processing - to ask us to limit how we use your information in certain circumstances.
  • The right to object - to object to us using your information, including for direct marketing or on legitimate interests grounds.
  • The right to data portability - to receive a copy of your information in a structured, commonly used and machine-readable format, in certain circumstances.
  • Rights related to automated decision-making - not to be subject to decisions based solely on automated processing that have legal or similarly significant effects.
  • The right to withdraw consent - at any time, where we rely on your consent. Withdrawing consent does not affect the lawfulness of any processing before you withdrew it.

If you would like to exercise any of these rights, or if you have a question about how we use your information, please contact us using the details in section 15. We will respond within one month, as required by law (this can be extended by two further months where requests are complex or numerous, in which case we will explain why). We will not charge a fee unless your request is manifestly unfounded or excessive.

We may need to verify your identity before responding to a request, to protect your information from being shared with the wrong person.

11. Complaints and the ICO

We want to handle your personal information properly and to deal with any concern you raise fairly. If you have a complaint about how we have handled your personal information, please contact us first using the details in section 15 - we would like the chance to put things right.

You also have the right to complain to the Information Commissioner’s Office (ICO), the UK’s independent regulator for data protection, at any time. You can contact them at:

Information Commissioner’s Office

Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF

Telephone: 0303 123 1113

Website: ico.org.uk

You do not have to complain to us first before approaching the ICO, though we would appreciate the opportunity to resolve matters directly.

12. How we keep your information secure

We take reasonable technical and organisational steps to protect your personal information against unauthorised access, loss, theft or misuse. Access to your information is limited to those who need it to do their work, and our systems and service providers are expected to maintain appropriate security standards.

No method of storing or transmitting information over the internet is completely secure, but we work to keep the risk as low as reasonably possible. If a data breach occurs that is likely to result in a risk to your rights and freedoms, we will notify the ICO, and where required, we will tell you as well.

13. Children’s information

Our services are aimed at adult landlords and property owners. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can delete it.

14. Changes to this notice

We may update this privacy notice from time to time to reflect changes in our practices, the law, or how we operate. The “Last updated” date at the top of this page shows when it was last revised. We will not make any significant change to how we use your information without telling you clearly.
